These Terms of Service cover your use of this website and our text messaging program. "We," "us," and "our" mean KLC Wellness LLC d/b/a Sunny Day Psychiatry. Section 1 contains our SMS (text message) terms.

1. SMS / Text Messaging Terms

Program name. Sunny Day Psychiatry Patient Messages.

Who sends the messages. KLC Wellness LLC d/b/a Sunny Day Psychiatry, from (215) 645-2830.

What the program does. We send appointment reminders and scheduling messages, and we exchange two-way text messages with patients about scheduling and practice questions. We do not send marketing or promotional messages.

What our texts will not contain. We do not text diagnoses, medication names, test results, treatment details, or anything discussed in a session. If you text us clinical details, we will not reply with clinical details by text. We will ask you to use the patient portal or call us.

How you opt in. You opt in by completing our ‘SMS Consent Form’. You complete this form during intake, on paper or in our patient portal. This form is optional. Consent to texts is not a condition of receiving care. After you opt in, we send one text confirming your enrollment, with instructions for help and opting out.

Message frequency. One reminder per scheduled appointment, plus two-way messages when you text us or when we need to reach you about scheduling. Message frequency varies.

Cost. Message and data rates may apply. Check your mobile plan for details. We do not charge for texts.

How to opt out. Reply STOP to any message. We also honor END, CANCEL, QUIT, UNSUBSCRIBE, and other plain requests to stop, by text, phone, email, or the patient portal. After you opt out, we send one text confirming it, and then we send no more texts. We process every opt-out promptly and no later than 10 business days after we receive it.

Opting out does not affect your care. Your appointments, treatment, and relationship with us stay the same. We will reach you by phone, email, or the patient portal instead.

How to opt back in. Reply START to our number, or tell us by phone, email, or the patient portal.

How to get help with SMS. Reply HELP to any message, call (215) 645-2830, or email info@sunnydaypsych.co.

Security of texts. Standard text messages are not encrypted from end to end. Your mobile carrier may store them, and anyone with access to your phone can read them. By opting in, you accept this risk for the limited content described above.

Not for emergencies. Our texts are not monitored around the clock. If you are in crisis, call or text 988, or call 911.

Your number. Tell us if your mobile number changes or if you give up your phone, so we do not text someone else.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Privacy. We do not sell, rent, or share your mobile number or text messaging consent with third parties or affiliates for marketing or lead generation. See our Privacy Policy.

2. No medical advice on this website

The information on this website is general and is not medical advice. Using this website, or sending us a message through it, does not make you our patient. A treatment relationship begins only after intake is complete and we agree to provide care.

3. Emergencies

We do not provide emergency services. Do not use this website, email, or text to report an emergency. If you are in crisis, call or text 988, or call 911.

4. Telehealth

We provide care by telehealth. You must be physically located in a state where our clinician is licensed at the time of each visit. Your intake documents, including our Confidentiality Agreement and Notice of Privacy Practices, govern your care. These Terms do not replace them.

5. Use of this website

You may use this website for personal, lawful purposes. You may not copy our content for commercial use, try to gain unauthorized access to the site, or interfere with how it works. Links to other websites are provided for convenience. We are not responsible for their content or privacy practices.

6. Disclaimer and limit of liability

This website is provided as is. To the extent the law allows, we are not liable for damages that result from using the website or from delayed or undelivered text messages. Nothing in these Terms limits our professional obligations to our patients.

7. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

8. Changes to these Terms

If we change these Terms, we will post the new version here with a new effective date. If we make a material change to the SMS terms, we will tell enrolled patients before the change applies.
