Privacy Policy

1. Introduction and Summary

Effective date: 10/01/2026

This policy explains what information Sunny Day Psychiatry collects through this website and our text messaging program, how we use it, and the choices you have. "We," "us," and "our" mean KLC Wellness LLC d/b/a Sunny Day Psychiatry.

1. We do not sell or share your information for marketing

We do not sell, rent, or share your personal information, including your mobile phone number, with third parties or affiliates for marketing or lead generation.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your text messaging opt-in data and consent will not be shared with any third party. The only exception is the service provider that sends and receives our text messages, which may use this information only to deliver messages for us.

We do not send marketing or promotional text messages.

2. Your health information

Information we create or receive while caring for you is protected health information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). Our HIPAA Notice of Privacy Practices explains how we use and disclose PHI and your rights. If this policy and the Notice ever conflict about PHI, the Notice controls. You can also ask us for a copy.

3. Information we collect

  • Contact details you give us, such as your name, phone number, email address, and date of birth, when you contact us, request a consultation, or complete intake.

  • Text messaging records, including your mobile number, the date, time, and method of your opt-in or opt-out, and the messages we exchange.

  • Health and insurance information that you or others share with us as part of your care. This is PHI and is covered by our Notice of Privacy Practices.

4. How we use your information

  • To schedule appointments, send reminders, and answer your messages.

  • To provide care, bill for services, and run our practice, as described in our Notice of Privacy Practices.

  • To keep a record of your text messaging consent and any opt-out.

  • To meet our legal obligations.

5. Who we share information with

  • Service providers that help us run the practice, such as our phone and texting service, our patient portal and health record system, and our billing support. Any provider that handles PHI signs a business associate agreement and may use the information only to provide services to us.

  • Your health plan and other health care providers, as described in our Notice of Privacy Practices.

  • Others when the law requires it, or when you give us written permission.

None of this sharing is for marketing or lead generation. Section 1 applies to every item above.

6. Text messages

What we text. Appointment reminders, scheduling and rescheduling messages, and replies when you text us.

What we do not text. We do not send diagnoses, medication names, test results, treatment details, or anything you discussed in a session. A typical reminder reads: "Sunny Day Psychiatry: Reminder of your appointment on Tue 10/6 at 3:00 PM. Reply to reschedule. Reply STOP to opt out."

If you text us clinical details. We will not reply with clinical details by text. We will ask you to use the patient portal or call us.

Security. Standard text messages are not encrypted from end to end. Your mobile carrier may store them, and anyone with access to your phone can read them. You can opt out of texts at any time and we will contact you by phone, email, or the patient portal instead.

Not for emergencies. Our texts are not monitored around the clock. If you are in crisis, call or text 988, or call 911.

Full text messaging terms, including how to opt in and opt out, are in our Terms of Service, section 1.

7. How we protect your information

We use administrative, technical, and physical safeguards to protect your information. We limit access to the people and service providers who need it to care for you or run the practice. No system is perfectly secure, so we cannot promise that information will never be accessed without permission.

8. Your choices

  • Stop texts by replying STOP to any message, or by telling us by phone, email, or the patient portal. Stopping texts does not affect your care.

  • Ask us to contact you a different way, such as phone only or portal only. We will follow reasonable requests.

  • See or correct your records as described in our Notice of Privacy Practices.

9. Patients under 18

If a patient is under 18, we follow Pennsylvania or New Jersey law on who may consent to care and who may receive messages about it. This website is not directed to children under 14, and we do not knowingly collect information from them online.

10. Changes to this policy
